学校引用的校规是《大连工业大学学生违纪处分规定》第十九条第六款。这条规定说： 他把两人的亲密影像发到粉丝群，配上了一句洋洋得意的评语，说中国女孩： 很快，视频和照片传遍全球，浏览量轻松破亿。有人统计，相关视频转发量约2.3亿次。

学校作为教育机构，其主要职责是教育和引导，有对学生违规行为一定程度上的处罚权，但不是越界去对学生的私生活作出道德审判，更不应以“国格”“校誉”之名，对个体实施近似私刑式的处罚。所谓“校规”如果违反法律的基本精神，就必须受到质疑甚至应当被放弃。

从法律层面而言，对于学生在校期间应该履行的校规校纪，即使高校具有一定的“自主决定权”，也不能以彻底牺牲或者贬损学生的基本权利为代价；而那种认为学校和学生之间是一种“命令与服从”的特别权力关系的理论，早在上世纪就已被彻底摒弃。

如此看来，大连工业大学的通报似乎就可以理解了——他们援引的是《大连工业大学学生违纪处分规定》的第三章第九十九条，“与外国外人不当交往，有损国格、校誉的，视情节给予记过及以上处分。” ...
